SALES CONTRACT

All bidders must agree to our Terms of Sale and acknowledge the same by bidding.

Inspection of auction items:

Since we are not experts in many of the types of assets we sell we all ways recommend the buyer inspect the item at our warehouse or simply hire a 3rd party locally to come out and inspect the auction item. Our customer service people are always willing help you find a local 3rd party inspector. Most inspections from local contractors run about $ 50.00. Please note:

1.All auction items are for sale and inspection in our store. All items with out/o bids meeting reserve are subject to prior sale in our store. However, once an item reaches the reserve price it will be marked sold in our store to protect the integrity of the auction.

2. We can not ship items with out: Name, Address & Phone#. No exceptions!

3. Effective 3/05: Buyers premiums are now included in your BID PRICE. Example: Final bid $ 100.00 your invoice will read $90 + $ 10 BP net = $100 + S&H. There is still be an additional 3.5% service fee for credit card payments.

King Surplus has been managing & remarketing surplus inventories & assets for more than 35 years. Our niche in the marketplace is similar to an auction company but instead of the public notoriety or liability found in public auctions we perform controlled liquidations over a 60 day period. We also recapture assets in other countries such as Mexico and bring them back to the USA. In the past 35 years we have liquidated countless types of companies and assets but we are not dealers or wholesales. Dealers and wholesales make up 90% of our buyers, they know what they are looking at and they set the price, we just manage the process.

The key to our success is building relationships that we can count on time after time to move a wide variety of assets, the world wide web community just happens to be one of those relationships. Our company's philosophy is to always value the relationship more than the money. However, since we are not dealers we can not service or warrantee the items we sell and we just wanted everyone to know that. That being said all sales are sold as is with no warrant expressed or implied as to fitness or use for a particular purpose. We will however stand by our word and intent as described here in and therefore will make certain reasonable guarantees as follows:

1. The background information or history of the item is as represented to us.


2. The item or items being offered are at auction and sold as is with no warranty expressed or implied as to fitness or use for a particular purpose or OSHA or MSHA safety standards.


3. For a period of not more than 10 days after shipment leaves KSC’s warehouse KSC will offer a refund subject to the following:
Buyer must send KSC IN WRITING a refund request with in 10 days from date of shipment from our warehouse. Upon receipt of request KSC will review request and at KSC’s sole discretion agree refund up to 100% of the purchase price only, not including SHIPPING & HANDLING BOTH WAYS. An example might be: purchase price $900.00 plus freight of $ 100.00 to deliver for a total of $ 1,000.00. To return item frt. will cost $100 and you may only get back $ 800.00 causing the buyer to loose $200 in shipping and handling expenses.


4. WE DO NOT REFUND, FILE CLAIMS OR COLLECT FOR FREIGHT DAMAGE THAT IS THE BUYERS RESPONSIBILITY. All shippers only pay your cost. If we file the claim they will only pay our cost or the cost of our client which is difficult to ID on older used assets. Therefore, the best freight claim process is to utilize the value when purchased from us, the only person that can honestly make that claim is the buyer. In addition, we ship everything best & cheapest way therefore any damage claim you may have could be limited. Insurance is available directly through shipping companies ,3rd party insurance which is highly recommended.

At King Surplus we try to go the extra mile to insure the price-point on each asset is such that it sells quickly, the net result is usually a great deal for the buyer. We also recommend all bidders look at the asset or know what they are doing before bidding, purchasing anything sight unseen is risky for the inexperienced buyer. However, as with all risk there is the potential for reward if the investor understands how to manage it.
